Terms of Service

Welcome to Trackara. By accessing or using our car project management app, you agree to be bound by these Terms of Service. Please read them carefully before using the app.

1. Acceptance of Terms

By downloading, installing, accessing, or using Trackara ("the App"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the App.

These Terms constitute a legally binding agreement between you and Commoner Apps LLC ("we," "us," or "our").

2. Account Creation & User Responsibilities

2.1 Account Registration

To access certain features of Trackara, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

2.2 Age Requirements

You must be at least 13 years old to use Trackara. If you are under 18, you must have permission from a parent or legal guardian.

3. Subscription Terms & Pricing

3.1 Subscription Options

Trackara offers the following subscription-based access to premium features:

• Monthly subscription: $1.99 USD per month
• Annual subscription: $14.99 USD per year

3.2 Automatic Renewal

• Subscriptions automatically renew unless canceled at least 24 hours before the current period ends
• Payment will be charged to your Apple ID account at confirmation of purchase
• Account will be charged for renewal within 24 hours prior to the end of the current period
• Subscriptions may be managed and auto-renewal may be turned off in your Apple ID Account Settings after purchase

3.3 Price Changes

We reserve the right to change subscription pricing. Any price changes will be communicated at least 30 days in advance and will not affect existing subscriptions until the next renewal period.

3.4 Refunds

All purchases are processed through Apple's App Store and are subject to Apple's refund policies. We do not provide refunds directly. For refund requests, please contact Apple Support.

4. Use License & Restrictions

4.1 License Grant

We grant you a personal, non-exclusive, non-transferable, revocable license to use Trackara for lawful personal or commercial purposes, subject to these Terms.

4.2 Prohibited Uses

You agree NOT to:

• Modify, decompile, reverse engineer, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for any unlawful purpose or to violate any regulations
• Attempt to gain unauthorized access to our systems or other users' accounts
• Transmit viruses, malware, or other harmful code
• Interfere with or disrupt the App's functionality or servers
• Use automated systems (bots, scrapers) to access the App
• Impersonate any person or entity or misrepresent your affiliation

5. Cloud Services & Data Storage

5.1 Cloud Sync

Trackara uses Firebase Cloud Services to provide cloud storage and synchronization of your project data across devices. By using these features, you acknowledge that your data will be stored on Google's Firebase servers.

5.2 Data Backup

While we implement backup systems, you are responsible for maintaining your own backups of important data. We are not liable for any data loss that may occur.

5.3 Service Availability

We strive to maintain 99.9% uptime for cloud services, but we do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.

6. User Content & Ownership

6.1 Your Content

You retain all ownership rights to the content you create, upload, or store in Trackara, including:

• Project data, notes, and documentation
• Photos and images you upload
• Budget and expense information

6.2 License to Us

By uploading content to Trackara, you grant us a limited license to:

• Store, process, and display your content to provide the App's services
• Create backups and ensure data availability
• Display content you choose to share via marketplace listings (when available)

This license ends when you delete your content or close your account, except for content shared publicly through the marketplace.

6.3 Content Responsibility

You are solely responsible for your content and warrant that:

• You own or have rights to all content you upload
• Your content does not infringe on third-party rights
• Your content does not violate any laws or regulations
• Your content does not contain malicious code or viruses

7. Marketplace Terms (Pre-Launch)

7.1 Waitlist Participation

The Trackara Marketplace is currently in pre-launch. By joining the waitlist, you agree to receive notifications about the marketplace launch and related updates.

7.2 Future Marketplace Terms

When the marketplace launches, the following terms will apply:

• Listing Content: You are responsible for accuracy and legality of all listings
• Prohibited Items: Stolen goods, illegal parts, or fraudulent listings are strictly forbidden
• Transaction Disputes: Disputes between buyers and sellers must be resolved between the parties
• Fees: Marketplace transaction fees will be disclosed before launch
• User Conduct: Harassment, fraud, or abusive behavior will result in account termination

7.3 Marketplace Disclaimer

Trackara acts as a platform connecting buyers and sellers. We are not a party to transactions and are not responsible for:

• Quality, safety, or legality of listed items
• Accuracy of listings or seller representations
• Buyer-seller disputes or transaction fulfillment
• Payment processing or refunds between users

8. OBD2 Scanner & Diagnostic Features

8.1 Compatibility

OBD2 scanner functionality is provided as-is. Compatibility and functionality may vary depending on:

• Your vehicle make, model, and year
• Your OBD2 adapter brand and capabilities
• Bluetooth connectivity and device compatibility

8.2 User Responsibility

You are responsible for:

• Ensuring your OBD2 adapter is compatible with your vehicle
• Proper installation and use of the OBD2 adapter
• Consulting qualified mechanics for serious vehicle issues
• Not relying solely on the App for safety-critical diagnoses

8.3 Diagnostic Disclaimer

OBD2 data and diagnostic codes are provided for informational purposes only. The App does not replace professional automotive diagnosis and repair. Always consult a qualified mechanic for vehicle issues.

9. Intellectual Property

9.1 Our IP

Trackara, including its design, features, code, and branding, is owned by Commoner Apps LLC and protected by copyright, trademark, and other intellectual property laws.

9.2 Feedback

Any feedback, suggestions, or ideas you provide become our property and may be used without compensation or attribution.

10. Account Termination

10.1 Termination by You

You may delete your account at any time through the App settings or by contacting support@commonerapps.com. Subscription fees are not refundable upon account deletion.

10.2 Termination by Us

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Abuse, harass, or threaten other users
• Compromise the security or integrity of the App

11. Disclaimers & Warranties

11.1 "As Is" Provision

Trackara is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Non-infringement or error-free operation
• Uninterrupted or secure access
• Accuracy or completeness of content

11.2 Third-Party Services

We are not responsible for third-party services integrated with Trackara, including Firebase, OBD2 adapters, or external links.

12. Limitation of Liability

To the fullest extent permitted by law, Commoner Apps LLC shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Service interruptions or data loss
• Third-party actions or content
• Unauthorized access to your account

Our total liability shall not exceed the amount you paid for the subscription in the 12 months prior to the claim.

13. Indemnification

You agree to indemnify and hold harmless Commoner Apps LLC from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use of Trackara
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or share

14. Governing Law & Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes shall first be resolved through good faith negotiations. If unresolved within 30 days, disputes may be submitted to binding arbitration in accordance with the American Arbitration Association rules.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through:

• In-app notifications
• Email to your registered address
• Updates on our website

Your continued use of Trackara after changes become effective constitutes acceptance of the updated Terms.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Commoner Apps LLC.

16.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full effect.

16.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
