Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Trackara, you agree to be bound by these Terms of Use. If you do not agree to these Terms, do not use the App.

2. Description of Service

Trackara is a car project management application available on iOS and Android. It provides tools for vehicle project tracking, maintenance logging, expense management, OBD2 diagnostic integration, and task planning.

3. User Accounts

You may use core features of Trackara without creating an account. Optional account creation enables cloud sync and access to account-dependent features. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Subscription and Payment

Trackara Premium is available at $3.99/month or $29.99/year. Subscriptions are processed by Apple App Store or Google Play and are subject to their respective terms of service.

  • Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
  • No refunds are provided for partial subscription periods except as required by applicable law.
  • Billing disputes should be directed to Apple or Google, as appropriate.

5. Acceptable Use

You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Reverse engineer, decompile, or disassemble the App
  • Transmit malware, viruses, or other harmful code
  • Attempt unauthorized access to our systems or another user's data
  • Use the App in any manner that could harm, disable, or impair Trackara or its users

6. OBD2 Integration Disclaimer

OBD2 diagnostic data provided through the App is for informational purposes only. Trackara is not a substitute for professional automotive diagnosis or repair. We are not liable for vehicle damage or personal injury resulting from actions taken based on OBD2 readings displayed in the App. Always consult a qualified mechanic for safety-critical repairs.

7. Intellectual Property

All content, code, trademarks, logos, and materials comprising the Trackara App and website are owned by Trackara or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

8. User Content

You retain ownership of all content you create within the App, including vehicle projects, photos, and notes. By using cloud sync features, you grant Trackara a limited license to store and process that content solely as necessary to provide the service. We do not claim ownership of your content and will not use it for any purpose beyond service delivery.

9. Marketplace Terms (Coming Soon)

When our Community Marketplace feature launches, additional terms will govern the buying, selling, and listing of parts and vehicles. We will publish those terms before the feature becomes available to users.

10. Privacy

Your use of Trackara is also subject to our Privacy Policy, which is incorporated by reference into these Terms of Use. Please review our Privacy Policy to understand our practices.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TRACKARA DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRACKARA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnification

You agree to indemnify, defend, and hold harmless Trackara and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your user content, or your violation of these Terms.

14. Termination

We reserve the right to terminate or suspend your access to the App at any time for violations of these Terms or for any other reason at our sole discretion, with or without notice. You may terminate your use of the App at any time by uninstalling it and cancelling your subscription through the appropriate app store.

15. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Texas.

16. Changes to Terms

We may modify these Terms of Use from time to time. We will notify you of material changes via the App or website. Continued use of the App following notification of changes constitutes your acceptance of the updated Terms.
